Legal Department Task and Responsibilities

The Legal Department of Undersecretariat for Defence Industries works under the headship of I.Legal Consultant directly connected to the Undersecretary for Defence Industries.

The Legal Department;

• Takes the legal steps to prevent the conflicts regarding the relations between the Undersecretariat and third parties which may result in legal, monetary and penal aspects and takes the legal proceedings against the conflicts before the competent authorities.
• Represents/advocates the Undersecretariat before the competent authorities and executes applications to court-bailiff’s office.
• Composes legal opinions regarding the functions performed by the Undersecretariat.
• Composes leading circulars in legal matters when necessary.
• Examines circulars, directives and bylaws concerning or prepared by the Undersecretariat in legal aspects.
• Directly carries out or attends the activities regarding laws and Decisions of Board of Ministers which the Undersecretariat is concerned.
• Examines the contracts or detailed descriptions of the terms of the contracts to be awarded regarding the projects or service procurements prosecuted by the Undersecretariat.
• Attends the activities regarding the projects or other transactions performed by the Undersecretariat.

Besides above mentioned functions, the Legal Department;

• Has been attending the commissions placing an order regarding the service procurements and exposition arrangements executed by the Undersecretariat.
• Had attended directly the activities for the preparation of the Standart Contract which was put into practice by the Undersecretariat.
• Had realized the preparation and the issue of the Decison of the Board of Ministers no: 2004/7354 and dated 12/05/2004 which describes the procurement conditions based on article 3/b of Public Procurement Law no:4734.
• In addition to above mentioned activities the Legal Department has been attending Strategical Planning and Process Analysis studies.

As a summary; oral and written legal aid is supplied to all departments of the Undersecretariat by the Legal Department, with regard to all activities within the functions of Undersecretariat for Defence Industries.
